Welcome to Impaks. These Terms of Service (“Terms”) govern your access to and use of the Impaks website, digital pack experience, collectible cards, Vault rewards, Marketplace, Impaks Points, promotions, and related services.
By accessing Impaks, creating an account, purchasing a product, opening a pack, using the Marketplace, or participating in an Impaks program, you agree to these Terms.
Eligibility
You must be legally permitted to enter into a binding transaction to make purchases through Impaks.
You are responsible for providing accurate account, payment, contact, and shipping information.
You are responsible for activity occurring through your account and for maintaining the security of your account credentials.
Digital Packs
Impaks offers digitally delivered collectible packs.
Pack contents may include digital collectible cards and, when applicable, an instant Vault reward.
Different pack types and Series may contain different distributions, guarantees, availability, and pricing. The applicable product page and Impaks Rules should be reviewed before purchasing.
Unless expressly stated otherwise, purchasing a pack does not guarantee any particular card, rarity, set, Vault reward, or monetary value.
The purchase of multiple packs does not guarantee a particular outcome unless such a guarantee is expressly stated for the applicable product.
Pack Assignment and Randomized Contents
Impaks packs may contain predetermined or system-assigned contents from an available pack pool.
Pack contents are not selected based on the identity of the purchaser.
Published odds or distributions describe the applicable pack pool or release and do not guarantee the results of an individual purchase.
Impaks may use automated systems to assign or distribute pack contents.
Digital Collectibles
Digital cards obtained through Impaks are collectibles used within the Impaks ecosystem.
They may be used for set completion, eligible redemptions, Marketplace transactions, bounties, promotions, or other features designated by Impaks.
An Impaks digital collectible does not provide ownership of intellectual property, trademarks, photographs, athlete likenesses, memorabilia, or physical items depicted on the card unless expressly stated otherwise.
Copying, downloading, photographing, or otherwise reproducing a digital card does not transfer ownership.
Impaks’ records determine recognized ownership for purposes of Impaks functionality.
Set Redemptions
Certain combinations of digital cards may qualify for rewards.
The cards and quantities required, available rewards, and redemption values may differ by Series.
Collectors must possess all required eligible cards at the time a redemption is processed.
Cards used for a completed redemption become redeemed and cannot subsequently be used for another redemption unless Impaks expressly provides otherwise.
Vault Rewards
Certain packs may contain Vault rewards.
Vault rewards may consist of physical collectibles, trading cards, autographed memorabilia, merchandise, experiences, Impaks Points, gift cards, or other items identified by Impaks.
A customer receiving a Vault reward must submit the Impaks Redemption Form.
Where offered for that Vault, the customer may select:
Ship Item — receive the physical item.
Sell on Marketplace — offer the item for sale through the Impaks Marketplace.
Exchange for Points — surrender the Vault item in exchange for the stated amount of Impaks Points.
Available options and values may vary by Vault.
Once a redemption has been processed, it is final.
Impaks Points
Impaks Points are a promotional/rewards currency for use within the Impaks ecosystem.
Impaks Points are not cash, are not a bank deposit, do not accrue interest, and cannot be redeemed for cash unless Impaks expressly offers such an option.
Points may be earned or issued through purchases, Vault exchanges, promotions, redemptions, or other activities.
Points obtained through a transaction may be removed if that transaction is canceled, refunded, reversed, disputed, or determined to be fraudulent.
Marketplace
Impaks may provide a Marketplace through which eligible digital collectibles, Vault items, or other approved items can be offered for sale.
Not every item or digital card is Marketplace eligible.
Marketplace eligibility, commissions, fees, payment procedures, shipping responsibilities, and other requirements may vary and will be disclosed when applicable.
A Marketplace transaction does not transfer ownership for purposes of Impaks functionality until the transfer is recognized within the Impaks system.
Pricing
Prices may change at any time before purchase.
The price displayed and accepted at checkout governs that transaction unless an obvious technical or pricing error occurred.
Impaks does not guarantee that a digital card, collectible, Vault item, or Marketplace item will maintain or increase in value.
Nothing sold by Impaks should be purchased as an investment or with an expectation of profit.
Technical Errors
Technology occasionally fails.
If a duplicate delivery, incorrect assignment, display error, pricing error, system malfunction, or similar problem occurs, Impaks may review its underlying transaction and assignment records.
A display or technical error does not create entitlement to an item or reward that was not legitimately assigned.
Likewise, a display problem does not eliminate a legitimate reward that Impaks can verify through its records.
Prohibited Conduct
You may not intentionally exploit bugs or technical errors; manipulate pack delivery or Marketplace systems; falsify ownership; interfere with other users; use fraudulent payment methods; abuse promotions; circumvent account restrictions; or otherwise attempt to obtain products, Points, cards, or rewards improperly.
Impaks may suspend accounts and reverse improperly obtained transactions, rewards, Points, or redemptions when reasonably necessary to address fraud or abuse.
Intellectual Property
The Impaks name, branding, logos, original card designs, graphics, website elements, pack designs, videos, and other original Impaks content are owned by or licensed to Impaks and may not be commercially reproduced or distributed without permission.
Changes to Impaks
Impaks is an evolving platform.
We may introduce, modify, or discontinue features, pack structures, Series, reward programs, Marketplace functionality, Points programs, or other services.
Changes will not intentionally remove a reward already legitimately earned and completed under the applicable terms.
Limitation of Liability
To the fullest extent permitted by applicable law, Impaks will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service.
Nothing in these Terms excludes rights or remedies that cannot legally be excluded.
Governing Law
These Terms are governed by applicable United States law and the laws of the state in which Impaks operates, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

2. IMPAKS REFUND POLICY

Digital Pack Purchases
Because Impaks packs contain digital collectible content that is delivered and revealed electronically, digital pack purchases are final once the purchased digital content has been delivered or accessed, except where required by applicable law.
A refund will not be issued solely because:
- A customer did not receive the card or rarity they wanted.
- A pack did not contain a Vault reward.
- A customer received duplicate cards.
- A customer did not complete a set.
- The perceived or secondary-market value of an item changes.
- A customer changes their mind after digital content has been delivered or revealed.
Technical Problems
If you purchase a pack but do not receive the digital content associated with your order, contact Impaks.
We will investigate the transaction and, when appropriate, restore the missing content, correct the delivery, replace incorrectly delivered content, or issue another appropriate remedy.
Duplicate or Incorrect Charges
If you believe you were charged incorrectly or charged more than once for the same transaction, contact Impaks so the payment can be reviewed.
Physical Vault Rewards
Physical Vault items are generally not returnable or exchangeable after the customer selects Ship Item, except where the wrong item was shipped, an item materially differs from its description, it arrives damaged due to fulfillment, or applicable law otherwise requires a remedy.
If an item arrives damaged, contact Impaks promptly and provide photographs of the item and packaging.
Marketplace Transactions
Marketplace sales may be subject to separate Marketplace terms depending upon the transaction.
Any applicable return, cancellation, seller, or buyer-protection terms will be disclosed as part of the Marketplace process.
Canceled or Fraudulent Transactions
Impaks may cancel and refund transactions reasonably believed to result from fraud, technical errors, unauthorized payments, or violations of Impaks rules.
Associated cards, Points, Vaults, or rewards may be removed when the underlying purchase is canceled or refunded.
Consumer Rights
Nothing in this Refund Policy limits rights or remedies that cannot legally be waived under applicable consumer-protection law.

This Privacy Policy describes how Impaks collects, uses, and shares personal information when you visit our website, make a purchase, create or use an account, participate in the Impaks ecosystem, contact us, or otherwise use our services.
Information We Collect
Depending upon how you interact with Impaks, we may collect information including:
Contact information such as your name, email address, telephone number, billing address, and shipping address.
Order information including purchases, order history, pack assignments, digital deliveries, Vault redemptions, Points activity, and Marketplace transactions.
Account information associated with your Impaks account and collection.
Payment information necessary to process transactions. Payment information may be processed by Shopify or other payment providers rather than stored directly by Impaks.
Device and usage information such as IP address, browser type, device information, cookies, website activity, and interactions with our services.
Communications you send to Impaks, including customer-service requests, redemption forms, and Marketplace communications.
How We Use Information
We may use personal information to:
Process purchases and payments;
Deliver digital packs and collectible content;
Maintain customer accounts and collections;
Track ownership and redemption eligibility;
Fulfill Vault rewards;
Operate Impaks Points;
Facilitate Marketplace transactions;

Shopify and Service Providers
Our online store is powered by Shopify.
Shopify and other service providers may process personal information on our behalf to provide ecommerce, payment processing, digital delivery, analytics, marketing, loyalty, fulfillment, fraud prevention, and other functionality.
These providers may process information according to their own privacy policies and our agreements with them.
Cookies and Tracking
Impaks and its service providers may use cookies and similar technologies to operate the website, remember preferences, understand website usage, measure performance, prevent fraud, and provide advertising or marketing where permitted.
Available privacy choices may depend upon your location.
Marketing
If you opt in to marketing communications, we may use your contact information to send information about new drops, products, promotions, Marketplace activity, and other Impaks updates.
You may unsubscribe from marketing emails using the unsubscribe option contained in those communications.
Transactional communications relating to purchases, accounts, deliveries, security, or redemptions may still be sent when necessary.
Sharing Personal Information
We may share information with service providers when necessary to operate Impaks, including ecommerce providers, payment processors, digital-delivery providers, shipping carriers, analytics providers, marketing providers, loyalty providers, fraud-prevention services, and professional advisers.
We may also disclose information when legally required or when reasonably necessary to protect Impaks, our customers, or others.
We do not sell personal information for money.
Certain advertising or analytics activities may legally constitute “sharing” or “selling” under particular privacy laws even when no money is exchanged. Where required, customers will be provided applicable privacy choices.
Data Retention
We retain personal information for as long as reasonably necessary to provide our services, maintain transaction and ownership records, comply with legal obligations, resolve disputes, prevent fraud, and enforce agreements.
Security
We use reasonable administrative and technical measures designed to protect personal information.
No internet-based service or storage system can guarantee absolute security.
Your Privacy Rights
Depending upon where you live, you may have rights concerning your personal information, including rights to request access, correction, deletion, or a copy of certain information, and rights concerning certain forms of data sharing or targeted advertising.

We may need to verify your identity before processing certain requests.
Children’s Privacy
Impaks is not intended for children who cannot legally provide the required consent or enter transactions under applicable law.
We do not knowingly seek to collect personal information from children in violation of applicable law.
Changes to This Policy
We may update this Privacy Policy as Impaks, our technology, or applicable requirements change.
The current version will be posted on our website with its updated date.
